CCH PROCEDURE / ADDING A WAIVER ISSUE DISCUSSED Appeal 081791 February 12, 2009 The hearing officer added an issue of waiver at the CCH based on good cause. A motion for continuance was granted. After a delay of eight months, the CCH was held. The hearing officer retained the waiver issue and determined that there was waiver concerning the extent of the injury. The Appeals Panel reversed with respect to the waiver issue
and discussed the rules for adding issues after the BRC. Here, there was no good cause to add the issue,
no unanimous consent to add the issue, no response to the BRC report, and no timely request. See Section
410.151 and Rule 142.7
