AGREEMENTS/REMAND REQUIRED TO DETERMINE WHETHER THERE WAS GOOD CAUSE
TO SET ASIDE AN UNREPRESENTED CLAIMANT’S CCH AGREEMENT
Appeal 081484-November 19, 2008

The claimant and the carrier made an agreement on the record at a CCH concerning disability. The claimant appealed stating that she thought that the meaning of the agreement was that she would get $8,000.00.

Since the claimant was unrepresented the test for setting aside an agreement is good cause (Rule147.4). The Appeals Panel reversed so a hearing could be held to determine whether there was good cause to set aside the agreement.
